Management and Operation Ordinance

Article 1 (Purpose)

The purpose of this ordinance is to stipulate matters necessary for the management and operation of the World Confucian Culture Museum in the City of Andong.

Article 2 (Definition of Terms)

The definitions of terms used in this Ordinance are as follows:

  1. 1“Child” refers to a person between the ages of 7 and 12.
  2. 2“Youth” refers to a person between the ages of 13 and 18.
  3. 3“Military and Police” refers to soldiers and police officers (including conscripted police and full-time reserve service) who wear uniforms and rank below sergeants.
  4. 4“Adult” means a person between the ages of 19 and 64.
  5. 5“Group” refers to a case where 20 or more paying visitors enter at the same time.
Article 3 (Operational Facilities)

The operating facilities of the World Confucian Culture Museum of the City of Andong (hereinafter referred as the “Museum”) are as follows.

  1. 1All exhibition facilities and spaces, including the Spirit Hall, Civilization Hall, and Future Hall
  2. 2Other convenient facilities
Article 4 (Opening and Closing)
  1. 1The Museum is open every day, except for those stipulated in Paragraph 2, and exhibits are open to the general public.
  2. 2The Museum is closed on the following days:
    • 1. January 1
    • 2. New Year’s Day (solar and lunar) and Chuseok
    • 3. Days set by the Seoul Metropolitan City Mayor (hereinafter referred to as the "Mayor")
    • 4. Other days as deemed necessary by the Mayor
  3. 3When the Mayor closes the museum pursuant to Paragraph 2, Subparagraphs 3, and 4, the details of the closure shall be notified on the museum bulletin board or website in advance.
Article 5 (Viewing and Ticketing Hours)

The ticketing and visiting hours of the Museum are as follows. However, if the Mayor deems it necessary, the ticketing and viewing time may be adjusted.

  1. 1Ticketing hours: 09:00 – 17:00
  2. 2Viewing hours: 09:00 ∼ 18:00
Article 6 (Admission Fee and Ticket Issuance)
  1. 1Those who wish to visit the Museum must pay the admission fee stipulated in the separate table.
  2. 2The Mayor shall collect the admission fee by selling tickets according to the ticketing system at the ticket booth.
  3. 3Tickets shall be issued separately for individuals and groups of children, youth, military and police, and adults, and are valid only on the day of purchase.
  4. 4Fees for ticket sales through the ticketing system shall be borne by the city.
Article 7 (Exemption of Admission Fee)

The Mayor shall exempt admission fees for those who fall under any of the following subparagraphs:

  1. 1State guest, foreign delegation, and their attendants
  2. 2Infants and toddlers under the age of 6 accompanied by a guardian, or a person over the age of 65
  3. 3A person on official duties
  4. 4A person with a disability welfare card and is registered as a disabled person under the [Act on Welfare of Persons with Disabilities]. However, in the case of a severely disabled person, one guardian is included.
  5. 5A person who falls under any of the subparagraphs of Article 86 (1) the Enforcement Decree of the Act on the Honorable Treatment of and Support for Persons of Distinguished Service to the State
  6. 6A person who falls under Article 15 of the [Enforcement Decree of the Act on the Honorable Treatment of Persons of Distinguished Service to Independence]
  7. 7A person who falls under Article 2 (2) of the [Act on Honorable Treatment of War Veterans and Establishment of Related Associations]
  8. 8A person who falls under any of the subparagraphs of Article 8 (3) of the [Act on Assistance to Patients Suffering from Actual or Potential After-effects of Defoliants and Establishment of Related Organizations]
  9. 9A person who falls under any of the subparagraphs of Article 52 (1) of the [Act on the Honorable Treatment of Persons of Distinguished Service to the May 18 Democratization Movement and Establishment of Related Organization]
  10. 10A person who falls under Article 58 of the [Act on Honorable Treatment of Persons of Distinguished Service during Special Missions and Establishment of Related Organizations]
  11. 11A person who falls under any of the subparagraphs of Article 17 (2) 1 of the [Act on Honorable Treatment of and Support for Persons Who Died or were Injured for Public Good]
  12. 12A person who is the registered ex-prisoner of war or the family members of prisoners of war from the places of detention pursuant to Article 2 (5) of the [Act on the Repatriation, Treatment of the Republic of Korea Armed Forces Prisoners of War]
  13. 13A person who is a recipient under Article 2 of the [National Basic Living Security Act] possessing the medical benefits certificate or a certificate of beneficiary
  14. 14A person who is an organ donor or registered to be an organ donor pursuant to Article 2 of the [Andong City Ordinance of the Promotion of Donation Registration of Organs, etc.]
  15. 15A multi-child household pursuant to the [Andong City Ordinance of the Preferential Treatment and Support for Multi-child Families] possessing Dabok Family Hope Card
  16. 16Field trips by daycare centers, kindergartens, elementary schools, middle schools, high schools, and universities in the City of Andong, led by homeroom teachers or professors in charge
  17. 17Officers and/or employees of research groups and specialized institutions visiting for academic purposes
  18. 18Children on Children's Day or soldiers on Soldier's Day
  19. 19A person who has contributed to the development of the Museum by donating or depositing artifacts and contents, and his/her family members
  20. 20Other people deemed necessary by the Mayor
Article 8 (Restrictions on Viewing)

The Mayor may restrict viewing of people who fall under any of the following subparagraphs.

  1. 1A person with mental illness and infectious diseases
  2. 2A person who is at risk of accidents due to excessive drinking
  3. 3A child under the age of 6 who is not accompanied by a guardian
  4. 4A person who carries a dangerous item or an item that interferes with viewing, etc.
  5. 5A person who is judged to be disruptive or likely to interfere with the viewing of others
Article 9 (Restrictions on Acts)
  1. 1Visitors must not engage in any of the following acts.
    • 1. Smoking, drinking, and cooking outside of designated areas
    • 2. Lighting or filming without the Mayor’s permission
    • 3. Disturbing other visitors with loud noise, etc.
    • 4. Destroying or damaging exhibits
    • 5. Other acts that significantly hinder the management and operation of the Museum
  2. 2The Mayor may request the removal of a person who has committed an act falling under any of the subparagraphs of paragraph (1).
Article 10 (Indemnification Measures)

When a visitor destroys or damages the Museum's exhibits or facilities, he/she must restore them to their original state or indemnify for the goods or money equivalent thereto.

Article 11 (Establishment and Composition of Committee)
  1. 1The Mayor shall establish the Andong World Confucian Culture Museum Committee (hereinafter referred to as the “Committee”) to consult and deliberate on the following matters.
    • 1. Matters concerning the basic policy for the operation and development of the Museum
    • 2. Matters concerning the improvement of the Museum's operation
    • 3. Matters concerning the sponsorship of the Museum
    • 4. Matters concerning business cooperation with other museums and various cultural facilities
    • 5. Matters concerning the collection, management, research, exhibition, etc., of artifacts and related materials
    • 6. Matters concerning the construction of knowledge and information related to Confucian culture
    • 7. Other matters necessary for the operation of the Museum
  2. 2The Committee shall consist of 10 or more and 15 or less members, including one chairperson, whom shall be elected from among the members.
  3. 3The members of the committee are divided into official members and commissioned members. The official member becomes the head of the Museum, and the commissioned member shall be a person commissioned by the Mayor from among experts and university professors with extensive knowledge and experience in Confucian culture. In this case, the specific gender of commissioned members shall not exceed 6/10 of the number of commissioned members.
Article 12 (Term of Official Member)

The term of office of official members shall be the same as the term of office of the member, and the term of office of commissioned members shall be two years.

Article 13 (Committee Meeting, etc.)
  1. 1Committee meetings shall convened by the chairperson when the chairperson deems it necessary, and meetings shall be held with the attendance of a majority of the members present. Resolutions shall be made with the consent of a majority of the members present.
  2. 2Members who attend the committee may be paid allowances and travel expenses within the budget. However, this is not the case when a member, who is also a public official, attends in direct relation to his/her duties.
Article 14 (Collection of Relics and Knowledge Information)

The Mayor may collect related relics and knowledge information to expand and improve global Confucian culture knowledge and information. In this case, the plan for data collection must be established after consultation with the committee.

Article 15 (Management of Collections)
  1. 1The Mayor shall create and manage a data list and data card for the collections, and periodically check for possible abnormalities in the collections.
  2. 2The Mayor must purchase damage insurance against theft, damage, fire, etc., of the collection.
Article 16 (Management and Operation)

The Mayor shall manage and operate the Museum. However, if it is deemed necessary for the efficient management and operation of the Museum, all or part of the facility may be consigned to a corporation or organization.

Article 17 (Selection of Consignee)
  1. 1A person who wishes to be consigned with the management and operation of the Museum (hereinafter referred to as “Consignee”) must apply to the Mayor, and the Mayor shall select an appropriate person among the applicants as a Consignee.
  2. 2When selecting a Consignee, the Consignee should be selected after comprehensively reviewing his or her financial burden capacity, facilities and equipment, degree of technology possession, responsibility capacity, and public confidence.
  3. 3When a Consignee is to be selected pursuant to Paragraph 2, open recruitment shall be the principle. However, if there is no applicant or if a valid general bidding is not established twice, a private contract can be made after evaluating the consignment performance capability and project execution plan.
  4. 4When the Mayor entrusts the operation of the facility, he/she may receive consignment usage fees from the Consignee. In this case, the consignment usage fee is determined by the market after considering the estimated price calculated based on income and expenditure as calculated through cost analysis by an agency specializing in calculating costs.
Article 18 (Conclusion of Agreement, etc.)
  1. 1The Mayor shall conclude a consignment agreement with the selected Consignee, including the contents of each of the following subparagraphs.
    • 1. Name of Consignee (or name of consigned institution) and address
    • 2. The contents of the consigned period, property, affairs, authority, etc.
    • 3. Method of collection and distribution of admission fees
    • 4. Matters concerning facility safety management
    • 5. Matters of fulfillment of obligations in case of violation of the contents of the agreement
    • 6. Other matters deemed necessary by the market
  2. 2The agreement must include necessary matters such as the duties of the Consignee, the contents of consignment, the consignment period, the amount of budget support, and the fulfillment of obligations in case of violation of the terms of the agreement.
  3. 3The consignment period shall be within 5 years, and a Consignee shall be selected according to Article 17 30 days before the consignment period expires.
Article 19 (Management of Consigned Property)
  1. 1The Consignee must fulfill one’s duties as a good manager in managing the consigned property, and in the event of damage to the consigned property, he/she must report to the Mayor without delay.
  2. 2Large-scale maintenance or repairs that change the original form of the consigned property shall be carried out directly by the Mayor, and minor repairs for maintenance and repair of the consigned property shall be carried out under the responsibility of the Consignee.
  3. 3The Consignee must obtain approval from the Mayor in advance when installing facilities or changing internal facilities.
  4. 4The Consignee shall comply with the agreements, orders, dispositions, and instructions pursuant to the relevant laws and regulations and this Ordinance.
Article 20 (Termination of Consignment, etc.)
  1. 1The Mayor may terminate the consignment if the Consignee falls under any of the following subparagraphs.
    • 1. When the terms of the agreement are violated
    • 2. When orders or dispositions under related laws or this Ordinance are violated
    • 3. In case of negligence in facility management or use in violation of the purpose of use
    • 4. If the consignment operation is difficult due to other unavoidable reasons
  2. 2When the Mayor intends to terminate the consignment pursuant to Paragraph 1, he/she shall listen to the opinions of the Consignee.
Article 21 (Guidance and Supervision)
  1. 1The Mayor may guide and supervise the overall management and operation of the Museum to the Consignee and request necessary data, and the Consignee must cooperate.
  2. 2The Consignee must report matters related to the management and operation of the Museum to the Mayor by the end of January every year.
  3. 3Regarding matters requiring correction and supplementation among the results under Paragraph 1, the Consignee shall correct and supplement without delay and report the results to the Mayor.
Article 22 (Operation Support)

The Mayor may subsidize expenses deemed necessary for the entrusted management and operation of the Museum within budgetary limits.

Article 23 (Restoration)

When the Consignee returns the facilities due to the conclusion or termination of the consigned agreement, the Consignee must restore the facilities to their original state and receive confirmation from the Mayor.

Article 24 (Indemnification for Damages)

If the Consignee intentionally or negligently loses or damages the facilities and the items stored in the facilities, he/she must restore them to their original state, and if restoration is impossible, he/she must indemnify for justifiable damages.

Article 25 (Mutatis Mutandis)

Matters not stipulated in this Ordinance regarding the consigned management and operation of the Museum shall be governed by the [Ordinance on the Management of Public Property in Andong City], [Ordinance on the Consignment of Private Affairs in Andong City], etc.

Article 26 (Enforcement)

Matters necessary for the enforcement of this Ordinance shall be determined by the Rules.

Addendum

This Ordinance shall be in force from the date of promulgation.
